O presidente do STF (Supremo Tribunal Federal), Cezar Peluso, determinou na noite desta terça-feira (4) que o processo de extradição do ex-ativista italiano Cesare Battisti seja desarquivado. No dia 31 de dezembro o ex-presidente Luiz Inácio Lula da Silva negou o pedido de extradição feito pelo governo italiano.
O processo de Battisti havia sido arquivado no início de 2010, após a Corte ter julgado o caso no final de 2009, quando os ministros determinaram que a decisão sobre o destino de Battisti seria tomada pelo presidente da República.
O processo foi desarquivado para a anexação de dois pedidos: o da defesa de Battisti, cobrando a soltura imediata do ex-ativista; e o da defesa da Itália, impugnando esse pedido. Após a juntada dos documentos, o processo será encaminhado à presidência do STF.
Segundo a defesa de Battisti, Peluso poderia determinar a soltura do ex-ativista sem desarquivar os autos. A opção pelo desarquivamento indica que o caso pode voltar a ser discutido pelo plenário do STF após o fim do recesso do Judiciário, que termina no final do mês.
Para a defesa da Itália, a decisão de Lula de não extraditar Battisti não é autoexecutável e ainda cabe ao STF analisar sua compatibilidade com o julgamento da Corte que determinou o retorno de Battisti para a Itália.
